This Terms of Service Agreement (the "Agreement") governs your access to and use of this website, www.ilvza.com, through which ILVZA Fragrances offers its own products for purchase, as well as your purchase of any product made available on this Website. ILVZA Fragrances is the sole owner and operator of this Website and of the products offered on it; it neither hosts nor sells any third-party goods, and no intermediary, reseller or partnership rights in the brand are held by, or extended to, any outside party. This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below.

ILVZA Fragrances reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any change, or a revised version of the Agreement, on this Website. Any such change or revision will be reflected by the date of change or revision noted at the top of this Agreement. The changed or revised Agreement shall take effect immediately upon being posted on this Website. Your continued use of the Website, or of the services available on it, following the posting of any such change or revised Agreement will constitute your acceptance of those changes or revisions.

ILVZA encourages you to review this Terms of Use Agreement each time you visit the Website, so that you remain aware of the terms and conditions governing its use. This Agreement does not alter, in any way, the terms or conditions of any other written agreement you may have with ILVZA Fragrances for other products or services. If you do not agree to this Agreement (including any policies or guidelines referenced within it), please discontinue your use of the Website and the services available on it immediately. By accepting these Terms of Use, whether implicitly or expressly, you also accept and agree to be bound by ILVZA Fragrances’ policies (including, but not limited to, the Privacy Policy), as amended from time to time.

Even so, ILVZA Fragrances and its service providers cannot promise that every piece of content, information, text, graphic, link or communication offered on or through the Website will always be accurate, complete, reliable or current, nor that the Website will run without the occasional error or interruption.

To run our services, we rely on trusted third-party providers to store and process the personal and other information you share with us, as described more fully in our Privacy Policy. The security of your personal information matters to us, and we maintain reasonable technical and organisational measures to protect it, in line with applicable law and our Privacy Policy. At the same time, we think it is only honest to acknowledge that no method of transmitting or storing information over the internet can ever be entirely secure. Where information such as your bank details, card details or other sensitive data is accessed without authorisation because of events truly outside our reasonable control, for instance widespread viruses, malware, hacking or similar third-party attacks, and despite the security measures we have taken, ILVZA Fragrances cannot, to the extent the law permits, be held liable for the resulting loss or claim. Throughout any such incident, and while it is being resolved, our Privacy Policy and our security obligations under applicable law remain fully in force.

Membership Eligibility

You can explore and shop on the ILVZA Fragrances Website either as a guest or by creating your own ILVZA Fragrances account. Certain services may require you to be logged in to your account and to have a valid payment method linked to it. Once you register, you become a Registered User, and the security of that account rests with you. This means keeping your password confidential, limiting who has access to your account, and accepting responsibility for everything done through it.

To open an ILVZA Fragrances account, you must be legally able to enter into a contract under the Indian Contract Act, 1872. Anyone classified as an "incompetent person" under that Act is not eligible to hold an account. A minor, meaning any person below the age of 18, may use the Website and make purchases only through, and under the supervision of, a parent or legal guardian. Should we find that an account is being used, or a transaction made, by a person who is not competent to contract under the Indian Contract Act, 1872, ILVZA Fragrances reserves the right to suspend or terminate that account and to decline further service.

Your Account and Registration Obligations

As a Registered User, you are responsible for keeping your User ID and Password confidential, and for all activity that takes place under them. When you register, or when you share details with us as a visitor, we ask that the information you provide be true, accurate, current and complete. If any of that information turns out to be false, outdated or incomplete, or if we have reasonable grounds to believe it is, or that it has been used in a way that breaches these terms, ILVZA Fragrances may suspend, block or terminate your access to the Website and its services.

Electronic Communications

By using the Website, or by sending us emails, data or any other communication, you are choosing to interact with us through electronic records, and you consent to receiving communications from us in the same form, from time to time and as needed. These may reach you by email or through any other suitable channel, whether electronic or otherwise. You are free to opt-in for promotional emails or newsletters, in line with the terms set out in our Privacy Policy.

Use of Products and Services

Everything ILVZA Fragrances offers on this Website is intended for your own personal use. Buying our products to further sell or resell them elsewhere is not permitted, and where such activity causes us harm, ILVZA Fragrances reserves the right to take appropriate legal action. So that your orders reach you smoothly, we may contact you by phone or email about order confirmations, tracking and delivery, and, where you have agreed to hear from us, about offers and campaigns as well.

Because fragrance is an intimate, skin-applied product, our items cannot be returned once delivered simply on a change of mind. We do stand behind what we send you, however. If your order arrives damaged, defective, or different from what you ordered, or if there is any issue with the delivery itself, please reach out to us within 24 hours of receiving it, and we will make it right. Details of how refunds are handled are set out in our Refund Policy.

Fees and Services

Creating an account and browsing the Website is free. The only amounts you are ever asked to pay are the price of the product you choose, any taxes applicable under Indian law, and delivery charges where they apply. When you place an order, you agree to pay these charges in line with our payment policies. If payment is not made, or is refused, after an order has been placed, ILVZA Fragrances may cancel the order or withhold delivery, and may issue a warning or suspend the account concerned. Where charges remain unpaid, we also reserve the right to pursue any remedy available to us in law to recover the amount due.

Use of the Website

By using this Website, you agree and confirm that your use of it will be governed by the principles set out below. You alone are responsible for the information you share, and you undertake not to host, display, upload, publish, transmit, modify, update or list any information or item that:

• Belongs to another person and to which you hold no right.
• Is harmful, harassing, defamatory, obscene, pornographic, paedophilic, libellous, hateful, or invasive of another person’s privacy, or is objectionable on racial or ethnic grounds, or that encourages money laundering or gambling, or is otherwise unlawful in any manner, including any content amounting to the "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.
• Harms minors in any way.
• Breaches any law currently in force.
• Threatens the unity, integrity, defence, security or sovereignty of India, its friendly relations with foreign states, or public order, or that incites the commission of any cognisable offence, obstructs the investigation of an offence, or is insulting to any other nation.
• Infringes any right belonging to ILVZA Fragrances or its representatives.
• Reproduces any content of this Website, which remains the proprietary property of ILVZA Fragrances and is protected by its intellectual property rights.
• Uses information available on the Website to mislead any other person.
• Publishes or shares any ILVZA Fragrances content on social media or elsewhere without our prior permission.
• Infringes the ILVZA Fragrances trademark, whether by adopting the mark itself or any mark in which "ILVZA Fragrances" forms an essential feature.

Limitation of Liability

To the extent permitted by applicable law, ILVZA Fragrances will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages arising out of or in connection with the Website, its services or this Agreement. This includes, but is not limited to, any loss of profits, goodwill, data, or use, or other intangible losses, however such loss may arise, whether in negligence, in tort, or under public policy.

Indemnity

You agree to indemnify and hold harmless ILVZA Fragrances, together with its owners, subsidiaries and their respective directors, officers, agents and employees, against any claim, demand, action or penalty, including reasonable legal fees, that may be brought or imposed by a third party as a result of your breach of these Terms of Use or any policy referenced within them, or of any law or regulation, or of the rights of a third party, including their intellectual property rights. This same protection applies to any loss, damage or cost we incur, including reasonable legal fees, arising from your use of software robots, spiders, crawlers or similar data-gathering tools, or from any other action on your part that places an unreasonable burden on our systems.

Dispute Resolution

For the most part, transactions on www.ilvza.com move along smoothly, and we hope your experience is no different. Should a concern arise, we would much rather understand it and put it right than let it stand. A dispute, in this context, simply means a disagreement between you as a buyer and ILVZA Fragrances in connection with a transaction on the Website. We will make every reasonable effort to hear you out and resolve the matter fairly and amicably before either side considers any formal or legal step.

Report an Intellectual Property Right Violation

If you believe that your intellectual property rights have been affected in any way through this Website, we want to hear from you. As ILVZA Fragrances sells only its own products and lists no third-party goods on this Website, questions of this kind are handled by us directly rather than passed to any outside seller. Where any claim of intellectual property infringement is instead raised against ILVZA Fragrances, we reserve the right to respond to and defend that claim in whatever manner we consider appropriate.

Governing Law and Jurisdiction

This User Agreement, together with all the rules and policies it contains, and any use you make of the Website or dealings you have with ILVZA Fragrances, is governed by and construed in accordance with the laws of India. Any matter arising from it falls under the exclusive jurisdiction of the courts at Gurgaon, India.

ILVZA Fragrances: Complaints and Escalation

If anything on this Website, or any conduct connected with it, breaches these terms or our Privacy Policy, you can raise it with us directly and we will look into it. This section sets out who to contact and what to expect.

General

Nothing in this User Agreement should be read as creating a partnership or an agency relationship between you and ILVZA Fragrances, and you hold no authority to act for or bind ILVZA Fragrances in any way.

Should any clause of this Agreement be found invalid, void or unenforceable for any reason, that clause will be treated as severable and its absence will not affect the validity or enforceability of the remaining clauses, which continue in full effect.

This Agreement represents the entire understanding between you and ILVZA Fragrances on the matters it covers. You may not assign or transfer this Agreement, or any rights granted under it, to another person. ILVZA Fragrances may, at its discretion, revise these Terms and Conditions at any time by posting the updated version on the Website, and any such change takes effect once it appears there. By continuing to use the Website afterwards, you accept the revised terms.

Disclaimer

ILVZA Fragrances are crafted using a blend of natural and carefully selected aroma ingredients. As with any fragrance applied to the skin, certain constituents — including Linalool, Limonene, Coumarin, Geraniol, and Citronellol — may cause sensitivity in some individuals, especially those with existing skin sensitivities or allergies. We recommend discontinuing use if irritation occurs.

We list the ingredients and usage guidance with each product, and we would gently encourage you to read them, and to seek professional or dermatological advice where you know yourself to be sensitive to any of them. Used with that awareness, ILVZA Fragrances cannot accept responsibility for reactions arising from a failure to observe the ingredient information or usage instructions provided. Any purchase made through www.ilvza.com is also subject to the specific conditions set out on the product packaging.
